Steve was an antiques’ dealer specialising in the sale of Indian and Japanese artefacts. Brian went into the shop and offered Steve £1,000 for an Indian Scimitar. Steve agreed to sell it. Brian offered to pay by cheque, which Steve refused to accept without proof of identification. Brian then said, "Don't you know who I am? I am Sir Richard Brandon." and gave his address as Brandon Hall. Steve checked in the local directory and found that Sir Richard Brandon lived at the address given. Brian also produced a golf club membership card containing Brian's photograph and with the name of Sir Richard Brandon on it. Steve allowed Brian to take the Scimitar. Brian sold the Scimitar to Bob, another antiques’ dealer, before Steve discovered that the cheque had been dishonoured by the bank.
Advise Steve whether he can recover the Scimitar from Bob. How would your answer differ, if at all, if the cheque had been dishonoured before Brian had sold the Scimitar to Bob?
